Terms of Use

These Terms of Use (“Terms”) govern access to and use of the GoldFish mobile application (“App”). By downloading, installing, opening, or using the App, you confirm that you have read these Terms and agree to comply with them. If you do not agree with the Terms, do not use the App.

1. Who provides the App

GoldFish is provided by the App developer (“we,” “us”). For questions related to the App, these Terms, subscriptions, or support, you can contact us at the email address shown on this page.

2. Purpose of the App

GoldFish helps recreational anglers plan trips. In the App, you can browse a map, save fishing spots, get weather information for selected coordinates, and view a calculated bite forecast by fish species.

The range of available features, forecast horizon, data granularity, and hourly display may depend on the App version, technical data availability, region, device settings, and your subscription plan.

All forecasts in GoldFish are informational estimates. They do not guarantee actual bite activity, catch results, weather conditions, or trip safety.

3. Not professional advice

The App does not provide professional, legal, navigation, meteorological, rescue, medical, or other expert advice. Information in the App does not replace official weather forecasts, public safety warnings, local fishing regulations, licensing requirements, seasonal restrictions, or safety rules on water or in nature.

You are solely responsible for checking on-site conditions, complying with laws and regulations, choosing route, tackle, bait, transportation, equipment, and safety measures. Use the App only as a supplementary informational tool.

4. Access to the App and accounts

At the time these Terms are published, the App may not require registration or login to an internal GoldFish account. Some features may work locally on the device, while access to paid capabilities may be determined through the app store where the purchase or subscription was made.

If we add registration, cloud sync, or other account-related features in the future, use of those features may be governed by additional terms or an updated version of these Terms.

5. Subscriptions, purchases, and paid features

Some GoldFish features may only be available through a paid subscription, in-app purchase, or another paid plan. Available plans, price, currency, billing period, trial period (if offered), and included paid features are shown in the App or in the relevant app store before purchase.

  • A subscription may renew automatically if it is set up as an auto-renewing subscription.
  • Payments are charged via Apple App Store, Google Play, or another store through which you made the purchase.
  • Subscription management, auto-renewal cancellation, and payment method changes are done in your account settings in the relevant store.
  • Deleting the App from your device does not by itself cancel an active subscription.
  • After cancellation, access to paid features is usually retained until the end of the already paid period, unless store rules or a specific offer state otherwise.
  • Refunds, payment reversals, disputed charges, and consumer rights are governed by the relevant app store rules and applicable law.

We may use a third-party subscription management service to verify purchase status, restore access, synchronize entitlements to paid features, and interact with app stores.

6. Trial periods and special offers

If a subscription includes a free trial, introductory price, promo offer, or other discount, the conditions of that offer are shown before checkout. After the trial or discounted period ends, the subscription may automatically switch to a paid period at the listed price unless you cancel it in advance in the app store settings.

Availability of trials and special offers may depend on platform, region, your purchase history, app store rules, and technical limitations.

7. Purchase restoration

If you reinstalled the App, changed device, or lost access to paid features, you may use purchase restoration if this feature is available in the App. Restoration works through the app store and depends on whether you use the same Apple ID, Google Account, or other store account used for the original purchase.

8. Acceptable use

You agree not to do the following:

  • use the App in violation of applicable law, fishing regulations, third-party rights, or app store requirements;
  • attempt to bypass payments, subscription checks, technical limits, security mechanisms, or access restrictions;
  • copy, modify, decompile, disassemble, or reverse engineer the App except where expressly permitted by law;
  • use the App to cause harm, harass, mislead, unlawfully collect data, or distribute malware;
  • create excessive load on the App, scrape data automatically, or interfere with third-party services used by the App;
  • use App forecasts or data as the only source for decisions related to safety, movement, weather risks, or legal compliance.

9. Saved spots and user data

You can save fishing spots, coordinates, place names, and other trip-planning information in the App. This information may be stored locally on your device in the App’s internal storage.

Certain coordinates or technical data may be sent to third-party providers only to the extent required for functionality, for example, to display maps, retrieve weather forecasts, or verify subscription status, as described in more detail in the Privacy Policy.

You are responsible for lawful use of selected locations, accuracy of saved data, and compliance with access rules for water bodies, private property, protected areas, and other locations.

10. Third-party services

GoldFish may rely on third-party services for specific features, including maps, weather data, app stores, payment infrastructure, and subscription management services. These services are provided by third parties and may operate under their own terms, privacy policies, technical limits, and availability rules.

We do not control all aspects of third-party services and are not responsible for their unavailability, delays, errors, data changes, pricing changes, or service termination unless otherwise required by applicable law.

11. Intellectual property

The App, including design, interface, graphics, text, calculation models, source code, data structure, the GoldFish name, and other elements, belongs to us or our licensors unless stated otherwise.

You are granted a limited, personal, revocable, non-transferable, and non-exclusive right to use the App on a compatible device in accordance with these Terms, the relevant app store rules, and applicable law.

You do not receive the right to sell, lease, distribute, copy, publish, modify, or create derivative products based on the App, except where expressly permitted by these Terms or by law.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, GoldFish is provided «as is» and «as available». We do not guarantee that the App will operate without errors, interruptions, delays, inaccuracies, loss of local data, or incompatibility with a specific device, operating system, region, or third-party service.

We do not guarantee the accuracy, completeness, timeliness, or fitness of bite forecasts, weather data, map information, or other materials for your specific purposes. Actual fishing conditions depend on many factors outside the App’s control.

13. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any losses, costs, damages, data loss, lost profits, loss of expected catch, or other consequences arising from use of the App, inability to use it, reliance on forecasts, weather conditions, errors or unavailability of maps, weather data, third-party services, user actions, violation of safety rules, fishing regulations, or legal requirements.

The user independently makes decisions about trips, fishing locations, safety, legal compliance, use of tackle, transportation, weather information, maps, and other information. All risks associated with such decisions and actions are borne by the user.

14. Changes to the App and Terms

We may update the App from time to time, modify, add, or remove specific features, fix bugs, change paid feature sets, or publish a new version of these Terms.

If the Terms change, we will update the «Last updated» date on this page. Continued use of the App after changes take effect means acceptance of the updated Terms unless applicable law requires separate consent.

15. Privacy

Processing of personal, technical, and locally stored data is described in the GoldFish Privacy Policy. Before using the App or purchasing a subscription, review the Privacy Policy separately.

16. Apple App Store rules

If you downloaded GoldFish through the Apple App Store, App use is also governed by applicable Apple rules, including Apple Media Services terms and App Store rules. Apple is not responsible for the App, its content, maintenance, support, user claims, or third-party claims unless required by mandatory Apple rules or applicable law.

These Terms are concluded between you and the GoldFish developer, not between you and Apple. At the same time, Apple and its affiliates may be considered third-party beneficiaries to the extent required by Apple App Store rules.

17. Google Play rules

If you downloaded GoldFish through Google Play, App use, purchases, subscriptions, cancellations, and refunds may also be governed by Google Play terms, Google Play Billing rules, and your Google account settings.

Google Play subscription management is typically done through the subscriptions section in Google Play. Deleting the App from your device does not automatically cancel the subscription.

18. Governing law and consumer rights

These Terms are drafted with general principles of regulation for digital services and mobile applications in mind. Nothing in these Terms limits your mandatory consumer rights that cannot be excluded or restricted under the laws of your country of residence.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the maximum extent possible.
